Important Information Before You Begin
1. Annual Rent Registration
- Deadline: March 1 every year.
- Who must register? Owners of any unit covered by:
- The Rent Adjustment Ordinance, OR
- The Just Cause for Eviction Ordinance.
- If you do NOT register annually, you CANNOT:
- Legally increase rents
- File or respond to a rent adjustment petition
- Evict tenants
2. Eviction Requirements
Before serving any eviction notice:
- Register your property at www.rentregistry.oaklandca.gov.
- File a copy of the termination notice with RAP within 10 days of serving it to the tenant.
Important: If you served an eviction notice before registering, you must:
- Register the property, AND
- Serve a new notice.
3. Additional Rules for No-Fault Evictions
(Examples: Owner move-in, relocation for repairs)
- No-fault evictions are prohibited if the owner is delinquent on business taxes.
- When serving a no-fault eviction notice, you must include:
- A copy of your current Business Tax Certificate
- A statement informing tenants about eviction limits for owners delinquent on business taxes.
4. Business Tax & RAP Service Fee
- To pay your Business Tax, obtain a Business Tax Certificate, and pay the annual RAP Service Fee, click here.
- Note: If you have not paid the RAP Service Fee:
- You cannot file or respond to a rent adjustment petition.
- Late penalties and interest apply after March 1.
